Trak Vault Marketplace Seller Terms

Effective date: November 1, 2026

These Seller Terms ("Terms") apply when you list an item for sale in the Trak Vault Shop (the "Marketplace"), which is operated by Trak Vault LLC ("Trak Vault", "we", "us"). They are in addition to our Terms of Use and Privacy Policy, which still apply. Where these Terms and the Terms of Use disagree about selling in the Marketplace, these Terms win.

By checking the box on the Sell page and listing an item, you agree to these Terms. If you do not agree, do not sell in the Marketplace.

These Terms cover Marketplace listings only. They apply to items members list for sale through Trak Vault and pay for through Trak Vault, shown in the Shop with the Trak Vault Marketplace name. The Shop also shows listings from other shops and marketplaces, such as eBay and TCGplayer. Those listings, the fees charged on them, and any sale made through them are governed by that site’s own terms, not by these Terms, and Trak Vault is not a party to them (see “Shops Outside the App” in our Terms of Use).

1. Who Can Sell

To sell in the Marketplace you must, at all times while you have listings or unfinished sales:

You may have one seller account. The information you give us and Stripe must be true, complete and kept up to date. When you set up payouts we pass Stripe your email, legal name, date of birth and address so you don’t have to type them again; you check them on Stripe’s pages. We may ask you to confirm your identity at any time, and we may refuse to let anyone sell.

2. What You Can List

Each listing is one of these kinds, and must be for exactly what you chose or described and nothing else:

By listing an item, you promise that:

Not allowed

3. Describing Your Item

Your listing must describe the actual item a buyer will receive, honestly and completely.

Photos

You must add at least one photo. Every photo must be one you took yourself of the exact item the buyer will receive, as it is now: the same copy, in its current condition, with the front and back shown where they matter. Stock photos, catalogue or official images, pictures copied from other listings or websites, and photos of a different copy (even an identical-looking one) are not allowed, including for graded or sealed items. Show any damage clearly.

A listing whose photos don’t match the item may be removed, and an item that doesn’t match its photos counts as not as described under section 6.

Condition

Choose the condition that fits the item, using these grades. For sealed product, Near Mint means factory sealed with no damage to the wrapper or box; describe any dents, tears or wear. For a lot, or a binder or box sold whole, choose the condition of the item in the worst condition, and describe the rest.

If the card differs from the catalogue entry in any way that matters to a buyer (a different printing, language, edition or misprint), you must say so in the listing.

Price and quantity

You set the price and the shipping price. Prices are in US dollars. For a card, the quantity is the number of copies you chose from your collection; a lot, or a binder or box sold whole, is one; for other items it must be the number you actually have to sell. You must keep it accurate. On a listing for several, the price is for each one.

Your collection and the item’s record

A card, sealed product, or binder or box you list is linked to its record in your Trak Vault collection. When the buyer’s payment goes through, that same record moves from your collection to theirs: a binder or box with every card in it, in the same pockets. It is transferred, not copied, so the item keeps its history: when it changed hands and what it sold for. Anyone who has owned that item through the Marketplace, including later buyers, can see that history, with the usernames of owners who have public profiles.

Locked until it arrives. From the moment a buyer starts paying for it until it reaches them (the carrier shows it delivered, or the buyer marks it received), neither you nor the buyer can change, move or delete it in the app. It is locked again while a return is on its way back to you.

If the sale doesn’t go ahead. If the sale is cancelled or refunded, or a return is completed, the record moves back to you, into the binder or box and pocket it came from where they are still free. Cards the buyer added to a binder or box they bought from you stay theirs. Items from collections we don’t track yet are not moved, but we keep your description with the sale and may use it to add the item to the buyer’s and your records once we do.

4. Fees and Payouts

Listing is free. When an item sells, Trak Vault charges a marketplace fee of 10% of the sale: the item price times the quantity sold, plus the shipping price you charged. When the items in a sale (the price times the quantity, not counting shipping) come to more than $10,000, the fee for that sale is 8.5% instead. Card processing by Stripe is paid out of our fee, not by you, and there are no other selling fees. The fee is shown on the Sell page before you list, and the fee for each sale is shown with it in your sales. We may change the fee in the future; a change applies only to sales made after we announce it, and we will tell you before it takes effect.

Buyers pay through Trak Vault, and payments are processed by Stripe. You never receive payment directly from a buyer, and you must not ask a buyer to pay you any other way.

On a small order (where our fee would not cover the cost of card processing and tracking, roughly orders under $10), the buyer also pays a small order fee at checkout, usually $1. It is paid by the buyer, goes to Trak Vault, and is not part of your sale: it doesn’t change your share or your marketplace fee.

When you are paid. Your share of a sale (the sale amount minus the marketplace fee) is sent to your Stripe account once the item has reached the buyer: when the buyer marks it received, or 3 days after the carrier’s tracking shows it delivered (when the buyer’s time to report a problem under section 6 ends), whichever comes first. If your listing accepts returns, payment also waits until its return window has ended, even if the buyer marks the item received sooner. If tracking can’t show a delivery (the carrier isn’t one we can track, or tracking stops updating), it is sent 14 days after you shipped, and in any case no later than 30 days after you shipped. While a buyer has reported a problem with the item, or the carrier says it was returned or could not be delivered, payment waits until the problem is settled. Stripe then pays it out to your bank account on its own schedule. Stripe’s own terms, including the Stripe Connected Account Agreement, apply to your Stripe account. We are not responsible for delays caused by Stripe or your bank.

Taxes. You are responsible for your own income taxes and any other taxes on your sales, except sales tax that we collect and pay to a state on your behalf where the law requires a marketplace to do so. Stripe may ask for tax information and may issue you a Form 1099-K as the law requires.

Money owed to us. If a sale is refunded or reversed after you were paid (for example after a chargeback, or a claim under section 6), you owe us the amount we refunded, less our fee where we return it to you. We may take it from your future sales or from your Stripe account balance, or ask you to pay it.

5. Shipping

A sale is binding once the buyer has paid. You will see the sale and the buyer’s shipping address in your sales.

If you can no longer send an item (it was damaged, lost, or sold elsewhere), cancel the sale in the app straight away. The buyer is refunded in full and you are not paid for that sale. Cancelling sales often can lead to your selling being limited.

If you ship late

Your ship-by date is shown with each sale: your handling time counted in business days (weekdays that are not US federal holidays) from when the buyer paid. If you haven’t added tracking by the end of that day (US Eastern time), you have 24 more hours. After that, the buyer chooses: give you until a later date, or cancel and be refunded in full. If they give you more time, the same applies to the new date. If neither of you does anything for 7 days, or the item still hasn’t shipped 30 days after the buyer paid, we cancel the sale and refund the buyer. You are not paid for a cancelled sale, so please don’t ship it after it is cancelled.

How often you ship by your first ship-by date is shown on your profile once you have shipped 5 sales.

6. Problems, Returns and Refunds

If a buyer has a problem with an item (it did not arrive, or it is materially different from your listing: a different card, a worse condition than described, or not genuine), they can report it in the app until you have been paid for it, and no later than 3 days after the carrier shows it delivered. They are encouraged to message you first, and you should try to put it right.

Returns. On each listing you choose whether you accept returns. If you do, you must take the item back for any reason, including a buyer simply changing their mind, if the buyer asks within your return window: 7 days after delivery unless you set a different window on the listing, which must be at least 3 and no more than 30 days after delivery. The buyer sends it back at their own cost, in the condition they received it, and is refunded once it reaches you. You may not refuse such a return or charge a restocking fee. Whatever you choose, an item that was not as described can always be returned. For a lot, or a binder or box sold whole, a return is for all of it.

We may, but are not required to, look into a problem, using the listing, the tracking information and anything either of you sends us. If we ask you questions, you must reply within 3 business days. If we decide the buyer should be refunded, we may refund them in full or in part. You are not paid for what was refunded, and if you were already paid, you owe us that amount as described in section 4. We may ask the buyer to return the item to you first: at your cost if the item was not as described, and at the buyer’s cost otherwise.

Buyers may also dispute a payment with their card issuer (a chargeback). Disputes are decided by the card issuer under the card network’s rules; because buyers pay through Trak Vault, the dispute comes to us and we respond to it through Stripe. You must give us any information we need to respond, such as proof of delivery. If the dispute is lost because of something you did or did not do, you owe us the disputed amount and any dispute fee charged to us.

7. Conduct

While selling in the Marketplace you must not:

Listing elsewhere

You may list the same item on other sites and shops at the same time, such as eBay, TCGplayer, Google Shopping or your own store. If it sells somewhere else, you must end your listing here, or lower its quantity, within 24 hours of that sale. If a buyer pays for it here before you do, you must either ship it to them or cancel the sale in the app straight away, as described in section 5. Sellers who often sell items here that they no longer have may have their selling limited.

8. Your Content

You keep ownership of the photos and text you put in your listings. You give Trak Vault a non-exclusive, royalty-free, worldwide license to store, display, resize and share them in the app, on our website and in our marketing of your listing and the Marketplace, for as long as the listing is up and for a reasonable time afterwards (for example in order histories). You promise you have the right to give us that license.

9. Our Rights

We may, at our discretion and without prior notice where we believe it is needed to protect buyers, sellers or Trak Vault:

We tell you when we take one of these actions, and you can ask us once to look at it again from the Account standing page in the app.

You may stop selling at any time by ending your listings. You must still ship, or cancel and refund, any sale that was already paid for.

10. Our Role and Liability

Trak Vault provides the Marketplace and handles payment for each sale, but the item, its description and its condition are yours, and the contract for the item is between you and the buyer. We do not inspect or authenticate items before they are sold.

To the fullest extent allowed by law, Trak Vault LLC is not liable for any indirect, incidental or consequential loss arising from your use of the Marketplace, and our total liability to you for any claim is limited to the marketplace fees you paid us in the 12 months before the claim arose.

You agree to cover any loss, claim or cost (including reasonable legal fees) that Trak Vault suffers because of an item you listed, your breach of these Terms or your breach of any law.

11. Changes to These Terms

We may update these Terms. When we do, we will change the date above and ask you to accept the new version before you create your next listing. Changes do not affect sales already paid for.

12. Governing Law and Contact

These Terms are governed by the laws of the State of Washington and applicable United States federal law, without regard to conflict-of-law rules. Nothing in them overrides any consumer protection law that applies to you.
